Terms ofservice

Kerwyn Joseph Photography is a photography studio operating in Trinidad and Tobago. In these terms, "we" and "the studio" mean Kerwyn Joseph Photography, and "you" means the person or organisation booking the session. Every amount on this site is in Trinidad and Tobago dollars.

Photography is charged by the hour. You choose how many hours you need, and studio hire, travel, add-ons and any licensing are added as separate lines so you can see what each part costs before you commit.

A date is not held until the retainer is paid. The retainer is 50 percent of the total, and it is shown on your booking before you pay. The balance is due on the day of the session, before the session begins.

Availability shown on the booking calendar reflects the diary at the moment you load it. In the rare case that a slot is taken between you choosing it and submitting, we will tell you and offer the nearest alternative rather than confirming a date we cannot honour.

Card payments are handled by our payment provider. We never see or store your full card number. Bank transfer and other arrangements can be agreed in writing before the session.

Work does not begin, and images are not delivered, until the amount due has cleared. If an invoice remains unpaid after the session, delivery is held until it is settled.

Life happens, and we would rather move a date than lose you. Tell us as early as you can and we will find another slot.

• Rescheduled more than 7 days before the session: the retainer moves to the new date at no extra cost.
• Rescheduled within 7 days: we will move the date where the diary allows, and the retainer moves with it once only.
• Cancelled by you: the retainer is not refundable, because the date was held and turned away from others.
• Cancelled by us: everything you have paid is refunded in full, including the retainer.

Outdoor sessions affected by weather are rescheduled, not cancelled, and no retainer is lost. The decision to move a session for weather is made jointly, as early in the day as is sensible.

Studio hire is charged separately from photography and is never folded into the hourly rate. Rates depend on the studio, the day and the time of day, and a session that runs across more than one rate period is split and charged at each period's own rate rather than at whichever rate applied when it started.

Studios have closed periods. A session cannot be booked across one, and the calendar will not offer a window that does.

The first 10 km from Port of Spain is included in every rate. Beyond that, travel is quoted by distance and appears as its own line on your booking. For locations that require a permit, the permit cost is passed on at cost and is also shown as its own line.

Finished galleries are delivered online through Pic-Time. Turnaround is between 5 and 28 days, depending on the service, counted from the date of the session, and the exact figure for your service is shown on your booking and in your client portal.

The number of edited images included is stated on your booking. Additional retouched images can be selected from your gallery and are invoiced separately at the rate shown at the time you select them.

Galleries remain online for the period stated when they are delivered. Please download and back up your images. We keep working files for a limited time and cannot guarantee that a gallery can be restored years later.

Copyright in every photograph stays with Kerwyn Joseph Photography. What you receive is a licence to use the images, and the scope of that licence depends on what you booked.

• Personal bookings: you may print, share and post your images for personal use, including on your own social media.
• Commercial bookings: the licensed use, territory and term are set out on your quote and are priced into it.
• Reselling images, or licensing them on to a third party, needs our written agreement first.
• Please do not crop out the frame, apply filters, or otherwise alter a finished image before publishing it.

Where you post an image publicly, a credit is appreciated but not required for personal bookings.

We may show work from your session in our portfolio, on social media and in submissions to publications. If you would rather we did not, tell us in writing and we will not, with no effect on your price. Some sessions are private by nature and we treat them that way by default.

Booked hours run from the agreed start time, not from when everyone arrives. If a session overruns at your request and the diary allows it, additional time is charged at the same hourly rate.

You are responsible for permissions at a location you have chosen, for the behaviour of your guests, and for the safety of the space. We reserve the right to end a session early, without refund, if anyone present is unsafe, abusive, or preventing the work from being done.

If equipment fails, we carry backups. In the unlikely event that a session cannot be completed or images are lost through our fault before delivery, our liability is limited to a full refund of what you have paid us, and we will offer to reshoot where a reshoot is possible.

We are not liable for indirect losses, and nothing in these terms limits liability where the law does not allow it to be limited.

We may update these terms. The version that applies to your booking is the version in force on the day you paid your retainer, and material changes are not applied backwards to a confirmed booking.

These terms are governed by the laws of Trinidad and Tobago, and any dispute falls to the courts of Trinidad and Tobago.
